Regarding non conforming speed limit, and placement/type of speed limit sign.
I live in a mobile home park. Recently recieved a ticket for 20mph in a 15mph. I was told that he couldn’t let anyone slide, because the park office asked that they crack down on speed demons flying through the park. I know the people in the park office. They not only speed around here in their car, but also in a Golf Cart…I have said countless times to my wife…"I can’t believe how fast the people in the office drive through here, you would figure they would be the ones to be driving properly". Then, there are some people that come through here well over 30mph…really flying…
Everyone goes through here well over 20mph. Im serious, you would need well over 50 squad cars with officers, because everyone coming through here would get pulled over.
The speed limit signs here are about 4 feet off the ground, and homemade. Out of engraved wood, thats says Slow, Children at Play, with a picture silhouette of a girl running, and under that, it says in even smaller lettering(about 4inch lettering) 15 MPH….
IT DOES NOT SAY SPEED LIMIT at all. Though there are other homemade signs that do say SPEED LIMIT 15MPH….but not until you get further into the park…
I came through the entrance, turned right, which you will see the sign that says Slow, Children at Play 15MPH. Now, this street has a very slight downhill grade, so you would have to ride your brake to prevent from going over 15mph. If I take my foot off the pedals, from a stop, my vehicle will go past 15mph…The officer was waiting at the curve. I never passed or came up to a sign that says SPEED LIMIT 15MPH…
Now, there are some people, that are definately going to fast…but compared to what Ive seen, I am far from the real problem..
Do you think I would be able to fight this ticket, regarding non conforming speed limit signs, and speed limits that do not conform to drivers habits….????

Also, for those who are going to say, "Do the crime, do the time", if that were the case, there would be no such thing as plea bargins, reduced charges, or any other types of deals that are cut in the "so full of holes and double standards" justice system….

Since it is a trailer park area, it is not bound by the state laws of the roadway since it is most likely private property of xx number of acres made into a park for mobile home, motor home, trailers etc.
Since it is a private road, the park as a community or the owners of the property would have a cause to post what they want(thus the homemade signs) as it is not a state, city or county roadway.
Driving laws with in a state, common sense within a park are, children playing, multiple housing around the area, would dictate SLOW DOWN.
Just because the owners do it does not make it right (But a good point to bring up at trial, who enforces the enforcement)
I am surprised it was not 10 or 5 mph posted.
The down hill grade is why the sign was posted as 15 ( why you have brakes in a car, most vehicles do go faster down hill then up hill)
none are needed since common since tells you it is the same as a parking lot 15 mph
The primary cause in fighting it is the signs. If they are not signs issued by the county/state, they are not valid, especially as they are not conforming to the required standards set for signs.
?? A sign does not need to SAY Speed Limit to be a marked speed limit. You knew it was the speed. And t does not matter if EVERY person speeds, that is still the limit, and you are guilty. Pay the fine, you will not win this fight.
it’s your right to fight any ticket, make sure you do your homework and get pictures to prove there is no posting of the speed limit and have a list of questions to ask the cop as he will have to take the stand against you. the speed limit in resdentual neghbor hoods is 25 mph this should be the bais of your aurgement
Depends on your state. Some states have basic speed laws that set the speed limit unless otherwise posted for specific road types. For example, in California the speed limit on residential streets is 25 MPH unless otherwise posted.
"and speed limits that do not conform to drivers habits….????" – Sorry, you have that one backwards. Drivers habits are to conform with the speed limits, not the other way around.

HOA is who fines people for violation on the property if it is a private community- not police
the cop most likely lives there too
if there is a gate at the entrance than the cop cant come in and write traffic tickets, unless he is needed because someone is blocking a fire-lane or an exit…or if a resident calls the police for an emergency,,
